This time it works, and now that little issue of the background is there, its awesome, i think the problem people are having is that it can default back to no background image if you change something else.
people DOUBLE CHECK EVERYTHING BEFORE CONVERTING, including the title menu preferred image you have choosen as it could have defaulted back by tweaking one of the other options.

-please beware there are at least 2 menus, your title and root menu so you need to make sure you are changing your background image in two places or at least the one that matters for you
-some dvd are made without the title menu (if you have added only 1 file to convert and you have left this option checked)
