Did you update NVidia drivers?
Nvidia changed those, removing ability to use Cuda on older cards, check on VideoConverter forum for more info about this.

I do have the newest drives but the problem isnt that the option is disabled it just doesn't seem to be using the gpu for the converting

Is there any way around this because the gtx 970 and 980 are brand new cards and cannot be put on the older drivers like other cards

This might be something else still, but it might require lot of troubleshooting.
Start by posting conversion log...

do you need a full convert or can a partial work I just start a conversion but its going to take about 3 hours

You can edit your conversion and convert like just 2 minutes of the video by using the cut function in the advanced editing window.

any word on this or will it just not work? Because when its not using the gpu it just converts way to slow

The logs show the hardware encoding and encoding are being used, but the problem is that they are slow?

yes very slow it will not convert faster then 20 fps on my older video card i was doing in excess of 300 fps

Can you try by disabling hardware decoding?
Maybe your graphic card doens't like to manage decoding and encoding tasks in same time...
2nd test, can you try by enabling hardware decoding ONLY (by disabling hardware encoding, enabling hardware decoding)

Do you used exactly same input file/output profile when getting 300fps with your old graphic card?

alright I disabled hardware acceleration and its just as slow my cpu should allow for converting faster then this I have a I7 4770k processor so I'm not sure what is going on.
