Encoding Mode: CPU??

Why, when I have a Nvidia 970, and my settings are set to use Hardware Encoding is ON, does the processing bar still say "Encoding mode: CPU (Software), and my CPU become saturated when converting videos into a DVD?

Because hardware encoders are only used for H264 encoding, when DVD Video standard uses Mpeg-2 video codec.

Oh, man, is this a slap in the face. :( So you're telling me that the only time that the program will use my CUDA cores is if/when I have it convert files to MP4? Or am I misunderstanding what you are saying?

H264 codec can be used for almost all containers... except DVD Video.
It can be used in mkv, avi, mp4, 3gp, mts, m2ts, AVCHD and Blu-ray.

We can't use hardware Mpeg-2 encoders from graphic cards because we need a lot of specific settings (not accessible in GPU) to create full DVD Video compliant files.

the sole purpose of ConvertXtoDVD is to create DVD´s (not to convert in mkv, avi, mp4, 3gp, mts, m2ts, AVCHD and Blu-ray.)
Ergo it´s harwareoptimization via Nvidia Cuda is useless
