Embedding ASS subtitle

Trying to convert AVI to MKV H264 with an embedded subtitle. If the subtitle to be embedded is of the srt variety there is no problem with embedding, however if the subtitle is of the ASS variety the embedding does not occur.So what am I doing wrong, I hope someone can help me it would be most appreciated. I am pretty sure I could do this with earlier versions
